Injury Trial Lawyers collects personal information that you choose to submit to us, such as through our contact form. We use it to respond to your inquiry, and we retain the information you submit. When you submit the form, our website sends a notification containing your information to the firm’s own email. We do not sell the information you submit through our contact form. Our website uses third-party services: our web hosting provider (WP Engine), Google Analytics, Cloudflare Turnstile, Google Maps, and Google Translate, as described below. We may also disclose information when the law requires or permits it, as described under Required Disclosures and Permitted Disclosures below. In order to guard your information, we maintain physical, electronic and procedural safeguards, but we cannot guarantee that your personal information will never be disclosed in a manner inconsistent with this policy.
Our website uses cookies and similar technologies. We use Google Analytics to understand how visitors use the site, such as the pages viewed, the date and time of a visit, and the website that referred you. Google Analytics also records when a visitor clicks our phone number or email address, including which part of the page the link was in, and when a visitor reaches the confirmation page shown after submitting our contact form. These records do not include what you type into the form. Google Analytics sets cookies in your browser and sends this information to Google. Cloudflare Turnstile, which helps protect our contact form from spam, may also use cookies or local storage, as described below. Other Google services built into our pages, including Google Maps on our contact page and Google Translate (used for our Spanish-language option), may also receive information such as your IP address and browser type and may use cookies or similar technologies. Google may collect information about your online activities over time and across different websites that use its services. Our website does not change how it works in response to “Do Not Track” or Global Privacy Control signals sent by your browser. Most browsers accept cookies by default. You can block or delete cookies in your browser settings. You can also opt out of Google Analytics by installing Google’s browser add-on.
Any changes to this privacy policy will be made through a revised posting on our website, and the “Last updated” date above will show when it was last revised.
California law requires lawyers to keep their clients’ confidential information confidential (Business and Professions Code section 6068, subdivision (e)(1); Rules of Professional Conduct, rule 1.6). Rule 1.18 also protects information from a person who consults a lawyer about possibly hiring the lawyer, even if no attorney-client relationship results. We handle information we receive through our website in accordance with these rules.
Non-Public Information We Collect
When you submit our contact form, we collect:
- your name, email address, and phone number;
- the text of your message; and
- the web page the form was submitted from, and the date and time of the submission.
After you submit the form, you are taken to a confirmation page.
Technical information, such as your IP address and browser type, is also received by Google (through Google Analytics) and by Cloudflare (through Turnstile) when your browser loads those services, as described in this policy. We may keep email correspondence and records of phone calls with you as part of responding to your inquiry. Submitting a contact form does not create an attorney-client relationship. Please do not include Social Security numbers, financial account numbers, or detailed medical information in the form; email and web forms are not always secure, and we can discuss the details when we speak with you.
Spam Protection on Our Contact Form
To help keep automated spam out of our contact form, we use Cloudflare Turnstile, a bot-detection check. When the form loads, your browser sends Cloudflare technical information, such as your IP address and browser type, so it can tell people from automated programs. Cloudflare states that Turnstile does not access or transmit what you type into the form, and Turnstile may use browser cookies or local storage to run its check. Parties to Whom We Disclose Information
We do not disclose confidential information about clients, former clients, or people who consult us about possible representation, except as required or permitted by law and the Rules of Professional Conduct, or with the person’s informed consent.
The categories of third parties that receive information through our website are our web hosting provider (WP Engine), Google (Analytics, Maps, and Translate), and Cloudflare (Turnstile). We do not sell the information you submit through our contact form.
Required Disclosures
In limited circumstances the law can require a lawyer to disclose information, for example by court order. Even then, we will protect client confidences to the fullest extent the law allows.
Permitted Disclosures
Prevention of serious harm
- California’s Rules of Professional Conduct permit, but do not require, a lawyer to reveal confidential client information to the extent the lawyer reasonably believes it is necessary to prevent a criminal act that the lawyer reasonably believes is likely to result in death of, or substantial bodily harm to, an individual (rule 1.6(b)).
Employees
- To respond to your inquiry or handle your matter, your information may be disclosed to our attorney and staff who need it.
Outside Providers
- On occasion, we may need to provide your confidential information to unrelated third parties who assist us with your matter, such as an accountant or other professional. We do this only as needed for that purpose and with your permission, or as otherwise permitted by law and the Rules of Professional Conduct.
Protecting the Confidentiality and Security of Client Information
To serve our clients and to comply with professional requirements, we retain records of the professional services that we provide. We maintain physical, electronic and procedural safeguards to protect the confidential information of our clients and former clients.
Request Not to Release Information
You may ask us not to release the information you have given us. We do not sell your personal information, and we release it only as described in this policy or with your consent. To make a request, call or email us using the contact information below, and we will respond. We may not be able to honor a request where the law or our professional obligations require us to keep or disclose information.
Our duty of confidentiality and the attorney-client privilege generally prevent us from releasing communications between you and our attorney without your consent. If you are a client, you can always ask us to release such information to anyone you designate.
