Complications Resulting from Coronavirus and Social Distancing Regarding Personal Injury Cases
While we are confident in our ability to continue representing our clients and fighting for their rights throughout this time, there will be some adjustments that we will have to make in consideration of things that do require face-to-face interaction. For one, working with the claims adjuster assigned to your case by the insurance company may pose some complications for their investigation.
On-Site Claims Investigation
For one, it is likely that a claims adjuster would ideally be able to meet with you in person in order to see the damage to your personal property, investigate the location of the accident, and generally gather a better sense of the situation by exploring the relevant locations and property. The adjuster may be able to carry on as usual with this portion of their investigation, provided that they do it alone and meet with you via conferencing software instead of in person.
Independent Medical Exams
If the insurance company requires that you submit to an independent medical examination in accordance with their policy, we will work with you in order to identify the most rational and safe way to do this in order to maximize your safety while not introducing any holdups to the investigation. Medical outlets are currently experiencing overwhelming volumes of patients, though, so we will need to make a determination of how to handle this on a case-by-case basis.
Negotiations
Once the investigation is completed, we will then be able to negotiate directly with the insurance company, predominantly via email and other remote methods. Again, this is business as usual for our team, since we rarely, if ever, have in-person negotiations, especially in the initial stages. If it seems that we are reaching an impasse or that additional steps will be necessary in order to find common ground with the insurance company, we will be able to consider the situation in context to the coronavirus restrictions at that time.
Filing a Lawsuit During Lockdown
If we decide that we must file a lawsuit in order to get you the compensation and justice that you deserve, we will likely run into complications if, at that point in time, the courts are still restricted as they are now. However, you may find relief in knowing that roughly half of all personal injury claims are settled before even requiring that the victim files an official lawsuit, and even fewer ever actually see trial.
Given the situation with the courts, we will need to pursue our negotiations even more aggressively than normal in order to hopefully reach a successful conclusion while using the currently available options such as email, video calls, and other forms of remote communication. If, however, we realize that we will need to leverage the courts in order to get you what you rightfully deserve, we will need to make the relevant determinations at that point in time.
